PRIVACY STATEMENT

The protection of your personal data is very important to us.

The text below explains the way and methods used to process the personal data we collect so as to ensure the protection of such data, as well as the rights you have vis-ΰ-vis your personal data.

Processing of personal data
Your personal data is collected and processed for the purpose of assessing your application.

Purposes of processing your personal data
The Consumer Protection Service (CPS) processes personal data in the course of performing its duties and responsibilities, which include:

    • providing information, personalised answers, advice and support to consumers in relation to their legal rights or problems that may arise from purchases they have made, as well as on issues related to product safety.
    • investigating complaints of possible violations of the law for the protection of consumers and their economic interests, to which the CPS or its Director is the Competent Authority.
    • receiving and examining applications for the approval of ADR Bodies.
    • conducting inspections/investigations into natural persons conducting business activity.
    • issues related to the control of concentrations between companies and the protection of competition

Storage of personal data
To perform the above tasks, the CPS uses a computerised system, access to which is restricted only to the CPS staff.

The personal data are stored, in print, in official files and/or, in electronic form, in the computerised system referred above.

Finally, for the purpose of facilitating consumers, the CPS operates the Consumer Helpline 1429. Telephone communications to the Consumer Helpline 1429 are being recorded in an electronic recording system, access to which is restricted to a limited number of authorised CPS officials.

How do we protect your personal data?
With regard to the computerised system of the CPS, access to your data is restricted to CPS officials who possess a unique username and password. Access to the data is also granted to specific officers of the Department of Information Technology Services (responsible for the technical support of the system), who also have a unique username and password.

Regarding the official files in which personal data are being stored, access is limited to the CPS staff that needs to have access to the files in order to perform its duties, as well as to the administrative staff of the Ministry of Energy, Commerce, Industry and Tourism.

Finally, regarding the electronic recording system of the Consumer Helpline 1429, access is restricted to a limited number of authorised officers who possess a unique username and password. The server of the system is locked in a safe room, access to which is permitted only to authorised personnel.

To whom do we disclose your personal data?
In the event that your request relates to a complaint against a trader, your personal data may be communicated to the trader and/or to another competent authority or organization if this is necessary for purposes of investigating the complaint.

If your request concerns another competent public authority of the Republic of Cyprus, your request will be transmitted and you will be informed, in accordance with article 17(5) of the General Principles of Administrative Law Act of 1999 (158 (I)/1999) .

For how long do we store your personal data?
Erasure of personal data stored in our computerised system and official files, is made within a maximum period of 5 years following the completion of the case handling.

Erasure of data from the electronic recording system of the Consumers’ Helpline 1429 is made within a maximum period of 24 months.

The abovementioned time periods may be extended if deemed necessary for objective reasons. No data are deleted in case there are any pending hierarchical appeals or legal or administrative proceedings relating to or in connection to the case.

Right to request access to and rectification or erasure of personal data
You have the legal right to request from the CPS access to and rectification or erasure of your personal data. You also have the right to request restriction of processing of your data or to object to processing as well as the right to data portability.

Right to withdraw your consent
Where the processing of your personal data is based on your consent, you have the right to withdraw your consent at any time. Please note that this right does not apply in cases where the processing of your personal data is necessary for the performance of a task carried out in the exercise of official authority by the CPS.

Consequences of failure to provide your personal data
In case of non-provision of your personal data or in case you exercise your right for erasure or for restriction of processing or to object to processing or to withdraw your consent, the CPS may not be able to handle the complaint or your request.

Right to lodge a complaint
You have the right to lodge a formal to the Commissioner of Data Protection in relation to the application of the legislation on the protection of natural persons with regard to the processing of personal data.
